Terms of Sale

1. Purpose
These Terms of Sale (hereinafter "the Terms") govern the sale of subscriptions to the Bingy service (hereinafter "the Service"), offered by Ulysse DUCAMP & Timothée MONNIER, via the website www.bingy.cc.
Any subscription implies unreserved acceptance of these Terms as well as the Terms of Use.
2. Description of the Service
Bingy is a subscription-based language learning service that adapts Netflix subtitles to the user's vocabulary level through a Chrome extension and an intelligent translation algorithm.
3. Pricing
The Bingy Premium subscription is offered at a rate of $34.99 USD per year.
Prices are listed in US dollars (USD), all taxes included. As a French micro-entrepreneur, VAT is not applicable (Article 293 B of the French General Tax Code).
Bingy reserves the right to modify its prices at any time. Price changes do not apply to current subscriptions and take effect at the next renewal.
4. Free Trial Period
Every new user receives a 3-day free trial period starting from the date of subscription.
During this period, the user has access to all features of the Service. If the subscription is not canceled before the end of the trial period, the first payment will be automatically charged.
Cancellation during the trial period is free and can be done at any time from the subscription management portal accessible on the website.
5. Payment Methods
Payment is made by credit card via the secure Stripe platform. Bingy does not store any banking information.
Payment is due immediately upon subscription (after the trial period, if applicable). The subscription is automatically renewed each year on the anniversary date, unless previously canceled.
6. Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium whose performance has begun with the consumer's agreement.
By subscribing to the Service and beginning to use it, the user expressly acknowledges waiving their right of withdrawal.
However, the 3-day free trial period allows users to test the Service without financial commitment before any charge is made.
7. Cancellation
The user may cancel their subscription at any time via the Stripe management portal accessible from the website. Cancellation takes effect at the end of the current subscription period.
Upon cancellation, the user retains access to the Service until the end of the already paid period. No pro-rata refund will be issued for the remaining period.
Bingy reserves the right to terminate a subscription in case of non-compliance with the Terms of Use, without notice or compensation.
8. Limitation of Liability
Bingy commits to providing the Service with due diligence. However, the Service is provided "as is" and Bingy does not guarantee uninterrupted availability.
Bingy's liability is limited to the amount of the subscription paid by the user over the last 12 months.

10. Mediation
In the event of an unresolved dispute, in accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, the consumer may freely use the mediation service. The competent consumer mediator is:

11. Governing Law
These Terms are governed by French law. In the event of a dispute and failing amicable resolution or mediation, the French courts shall have exclusive jurisdiction.
